1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Ashburn Wine Shop, Wine Bar & Bistro ("we," "us," "our"), 44050 Ashburn Shopping Plaza, Ste 159, Ashburn, VA 20147. By using awswine.com (the "Site") or placing an order through it, you accept these Terms and our Privacy Policy. If you do not agree, please don't use the Site.

Plain EnglishUsing the site means you accept these rules. They're short and mostly common sense.

2. Age requirement

You must be at least 21 years of age to purchase alcohol through the Site or in our shop. By placing an order containing alcohol, you represent that you are 21 or older and that the person picking up the order will present valid, government-issued photo identification proving they are 21 or older. We refuse sale and cancel orders where age cannot be verified, as required by Virginia law and Virginia Alcoholic Beverage Control Authority regulations.

Plain English21+, no exceptions, real ID at pickup. Virginia law and we take it seriously.

3. Pickup only — no shipping or delivery

All online orders are fulfilled exclusively by in-store pickup at our Ashburn location. We do not ship, deliver, or transfer alcohol. The person named on the order (or a designated alternate pickup person, who must be 21 or older and present their own valid photo ID) must collect the order in person. We may require the payment card used for verification. Orders are held for pickup for a limited period as described in our Return & Pickup Policy.

4. Orders, acceptance, and availability

Your order is an offer to purchase. Our acceptance occurs when we confirm the order is ready for pickup. Inventory shown on the Site reads from our register system and is updated frequently, but on rare occasions an item may sell out in-store before your order is prepared. If that happens we will contact you to substitute an item of equal value or refund the difference or the full item price, at your choice. We may cancel and refund any order we reasonably believe violates these Terms or applicable law.

5. Pricing and taxes

Prices are in U.S. dollars and may change without notice. Applicable Virginia sales tax is added at checkout. In the event of an obvious pricing error, we may cancel the affected order and issue a full refund.

6. Reservations, events, and third-party tickets

Table reservations and event RSVPs submitted through the Site are requests, and are not final until we confirm them by email or text. Some events are ticketed through Eventbrite; purchases made there are governed by Eventbrite's terms and are subject to the refund terms stated on the individual event listing.

Plain EnglishA reservation isn't booked until we say "confirmed." Ticketed events run through Eventbrite and follow the event listing's rules.

7. Acceptable use

You agree not to misuse the Site — including submitting false reservations or orders, attempting to purchase alcohol for a person under 21, scraping or disrupting the Site, or interfering with other customers' use. We may refuse service or cancel transactions that violate this section.

8. Intellectual property

The Site's content — text, photography, logos, and design — belongs to Ashburn Wine Shop or its licensors and may not be reproduced or used commercially without our written permission. Third-party product names and label imagery belong to their respective owners and are used to identify the products we sell.

9. Disclaimers and limitation of liability

The Site is provided "as is" and "as available." To the fullest extent permitted by Virginia law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, and we are not liable for indirect, incidental, special, or consequential damages arising from use of the Site. Our total liability for any claim arising out of a purchase is limited to the amount you paid for the products at issue. Nothing in these Terms limits liability that cannot be limited under applicable law.

Plain EnglishIf something goes wrong with an order, we'll make it right up to what you paid. We can't take responsibility beyond that.

10. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts serving Loudoun County, Virginia, and you consent to their jurisdiction. Before filing anything, please just call us — we solve nearly everything with a conversation.

11. General

If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
